This study considers freedom of speech and the rules of engagement in the public sphere; good government, civic responsibility, and public education; and the foundations of religion and society, as seen through the eyes of seventeenth-century Dutch philosopher, Spinoza.

This is first English edition of Ethical Concepts and Problems (1971) by the great Danish philosopher and theologian K. E. Løgstrup (1905-81). Løgstrup presents key elements of his ethical and political thinking, on topics from duty, responsibility, will, and choice to cultural policy, democracy, and the right of resistance.

Conscious but incapacitated patients need protection from both undertreatment and overtreatment, for they are exceptionally vulnerable, and dependent on others to act in their interests. In the United States, the law prioritizes autonomy over best interests in decision making. Yet U.S. courts, using both substituted judgment and best interests decision making standards, frequently prohibit the withdrawal of life-sustaining treatment from conscious but incapacitated patients, such as those in the minimally conscious state, even when ostensibly seeking to determine what patients would (...) have wanted. In the United Kingdom, under the Mental Capacity Act of 2005, courts decide on the best interests of incapacitated patients by, in part, taking into account the past wishes and values of the patient. This paper examines and compares those ethicolegal approaches to decision making on behalf of conscious but incapacitated patients. We argue for a limited interpretation of best interests such that the standard is properly used only when the preferences of a conscious, but incapacitated patient are unknown and unknowable. When patient preferences and values are known or can be reasonably inferred, using a holistic, all-things-considered substituted judgment standard respects patient autonomy. (shrink)

In addition to the transmission of the science of hadith from the Eastern Islamic world to the west, particularly to Andalusia, a rich literature also developed in Andalusia. Therefore, the development of the science of hadith and hadith methodology in the Andalusian region and the impact of scholars from that region on these sciences is an important issue that deserves attention. This article examines how the intellectual atmosphere of Andalusia was enriched by the hadith works that came from the East (...) and the scholarly activity these works generated. It also addresses the hadith methodology literature that emerged in the Andalusian region and the reflections of this literature in the hadith methodology works of the From this perspective, the study first briefly highlights the hadith and hadith methodology literature that reached Andalusia from the Mashriq region, followed by the works written by Andalusian scholars that contributed to the hadith methodology literature. Subsequently, the influence of hadith methodology works by hadith scholars from the Eastern Islamic world on Andalusian literature is examined. Furthermore, the study evaluates how Andalusian scholars were referenced in the Mashriq hadith methodology literature and their influence on these works. Through this analysis, the interaction between the Mashriq and Andalusian regions within the context of hadith methodology is demonstrated. The contribution of Andalusian scholars to the hadith literature by enriching the knowledge and expertise they received from the East with their interpretations and original works increased the importance of the region in the Islamic world. Additionally, the influence of the hadith methodology works written in Andalusia on Eastern literature reveals the reciprocal nature of cultural interaction. (shrink)

Technological demands of the LDC's producing horticultural products is also increasing. Pesticide use is an integral component of most agricultural production, yet chemicals are often supplied without supplemental information vital for their safe and efficient implementation. Illiteracy rates in developing countries are high, making pesticide education even more challenging. For women, who perform a significant share of agricultural tasks, illiteracy rates are even (...) higher than for men. The dilemma exists of how a developing country can improve its nutritional and economic situation without giving consideration to social and environmental consequences. (shrink)

Nikolai Fedorovich Fedorov is one of the most original and as yet inadequately studied Russian thinkers. Neither a professional philosopher, nor a well-known scholar, nor a critical essayist, he led a kind of double existence while working as an ordinary civil servant, developing his original philosophy at his leisure in the hours free from his intensive daily work. Fedorov's life was one of selflessness and self-denial, not at all eventful outwardly. He graduated from the Gymnasium in Tambov and completed three (...) years of study in the Law Department of the Richelieu Lyceum in Odessa, after which he taught for a number of years in the Borovsk, Lipetsk, Podol'sk, and other regional schools. The quarter century he spent working in the Library of the Rumiantsev Museum in Moscow was the most stable period in Fedorov's life. Fedorov's ideas attracted the attention of outstanding cultural figures. F.M. Dostoevskii became acquainted with them in 1878 through Peterson, and on March 24 of that year he wrote: "I am essentially in full accord with these ideas. I read them as if they were my own." L.N. Tolstoy, who knew Fedorov personally, said, "I am proud to be living in the same times as such a man." V.S. Solov'ev, who also associated with Fedorov, wrote to him as follows in the mid-1880s: "Your ‘project’ is the human spirit's first advance along the path of Christ since the advent of Christianity. As for me, I can only acknowledge you as my teacher and spiritual father." A.M. Gorky was especially impressed by the activism in Fedorov's views. But none of this precludes the many and very essential divergences of these authors from Fedorov. One can find some links with his ideas in A.N. Belyi, V. Ia. Briusov, N.A. Zabolotskii, V.V. Maiakovskii, A.P. Platonov, M.M. Prishvin, I.L. Sel'vinskii, O.D. Forsh, and V.N. Khlebnikov. The artist B.N. Chekrygin drafted a large fresco entitled The Resurrection of the Dead [Voskreshenie mertvykh] and a philosophical work entitled The Synod of the Resurrecting Museum [Sobor voskreshaiushchego muzeia], both inspired by Fedorov's teachings. Patricia White has recently attempted to construct an ethically valid notion of forgiveness that will serve educational purposes and contribute to the moral development of pupils in schools. She distinguishes between a strict view that requires repentance before forgiveness, which she rejects, and a relaxed view that does not require repentance, which she endorses. In this reply I defend the strict view of forgiveness against her criticism and challenge the ethical propriety of the relaxed view. I shall argue that her (...) support for the relaxed view both runs counter to our deepest moral intuitions and serves to undermine the moral law and moral endeavour. (shrink)

Given the dominance of 'cognitivist' theories of emotion in the philosophy, neurobiology, and cognitive science of emotion, we have witnessed a move away from attempts to pit reason and emotion against each other. An Acquaintance of mine decided, in the late 1950s, to become an officer in the U.S. Navy, until he discovered a Navy regulation stating that ugly men would not be accepted as officer candidates. Surely there is something suspicious about such a policy. Yet, in a time when people are so conscious of the many forms of discrimination — race, colour, sex, age, religion — it is somewhat surprising that little serious attention is given to the practice of what I (...) shall call ‘aesthetic discrimination against persons’, discrimination on the basis of appearance or looks. It is true that, in recent years, some social scientists have conducted research leading them to the conclusion that human beings prefer and esteem good looking people over plain or ugly ones. Theory of Mind is the cognitive achievement that enables us to report our propositional attitudes, to attribute such attitudes to others, and to use such postulated or observed mental states in the prediction and explanation of behavior. Most normally developing children acquire ToM between the ages of 3 and 5 years, but serious delays beyond this chronological and mental age have been observed in children with autism, as well as in those with severe sensory impairments. We examine data from studies (...) of ToM in normally developing children and those with deafness, blindness, autism and Williams syndrome, as well as data from lower primates, in a search for answers to key theoretical questions concerning the origins, nature and representation of knowledge about the mind. In answer to these, we offer a framework according to which ToM is jointly dependent upon language and social experience, and is produced by a conjunction of language acquisition with children's growing social understanding, acquired through conversation and interaction with others. We argue that adequate language and adequate social skills are jointly causally sufficient, and individually causally necessary, for producing ToM. Thus our account supports a social developmental theory of the genesis of human cognition, inspired by the work of Sellars and Vygotsky.How are we to decide whether to take reason to be an essentially private thing that can, however, turn on a public display when it chooses to do so, or, like conversing, to be an essentially social skill, which can, however, be retained a while through periods of solitary confinement? .The squirrel does not infer by induction that it is going to need stores next winter as well .The problem of thought and language thus extends beyond the limits of natural science and becomes the focal problem of historical human psychology, i.e. of social psychology. The path from object to child and from child to object passes through another person. Hanlester Network v. Shalala ) marks the first test of the application of the Medicare-Medicaid anti-kickback statute to physician self-referral joint ventures. The most recent development in this ongoing litigation was the April 6, 1995 decision of the Ninth Circuit Court of Appeals, holding the Hanlester Network vicariously liable for its marketing vice president's knowing and willful violation of the antikickback statute. The vice president had offered to pay physician-investors in order to induce their referrals of program-related business.The Hanlester Network (...) was a California general partnership comprised of corporations, clinical laboratories, and individual investors. The facts that led to establishment of the special theory of relativity are reanalyzed. The analysis leads to the well-known formalism, involving, however, somewhat unusual notations. The object of the analysis is to start more closely from the directly observed experimental facts than is usually done; at the same time, great stress is laid on giving formulations independent of the representation in particular reference systems. A detailed analysis is given as to the actual physical methods involved when introducing three- or (...) four-dimensional reference systems. The orthogonal transformations and also the Lorentz transformations are introduced not so much as coordinate transformations but as operators reflecting physical properties of material systems. The principle of relativity is replaced by a mathematically equivalent principle denoted as theLorentz principle which reflects certain symmetries of the known physical laws. (shrink)

Since the role of the Asian countries is increasing in the modern world, their philosophical traditions attract more and more attention. Due to this trend, a more complete panoramic view of the development of world philosophy as a whole is accessible, and it has become possible to understand that any constructions of the human mind that have arisen in a particular cultural field of experience cannot be regarded as exemplary and absolute. The researchers of Asian philosophies concentrate mostly on studying (...) the texts of individual thinkers. As a rule, they do not set themselves the task of examining these texts from the point of view of intercultural interactions and transformations of significant ideas and concepts in various cultural and historical contexts, defining the direction and mechanisms of cultural borrowing, as well as revealing new approaches and growth points. To achieve these goals, the research should focus at the problem of the self-determination and development of philosophy as a separate science in non-Western cultures, which are based on intellectual traditions with different origin than Greek and Judeo-Christian traditions. This article deals with the consideration of some topics that elucidate the features of the development of philosophical science in Japan, including the emergence of the concept of “philosophy” in this country, the definition of its subject, the formation of philosophical terminology, and various interpretations of what the term “Japanese philosophy” means. The author pays special attention to the characteristic of the main periods of progress of Japanese philosophical thought. In the conclusion, the author argues that the most important characteristic feature of the Japanese philosophy is its involvement in intercultural dialogue throughout its history. (shrink)
